Does Every Estate Have to Go Through Probate?

One of the most common questions we receive is whether formal probate is mandatory. As of 2026, California has significantly updated the “Small Estate” thresholds. These changes allow more families to bypass the lengthy formal court process if the estate falls under specific statutory limits:

Small Estate Affidavit ($208,850 Threshold)
For deaths occurring on or after April 1, 2025, if the total value of personal property is $208,850 or less, heirs can often use a simplified affidavit process instead of a full probate.
Primary Residence Successions ($750,000 Limit)
Under recent legislation (AB 2016), if the deceased person's primary residence in California is valued at $750,000 or less, a simplified court petition may be available to transfer the home, saving months of time and thousands in fees.
Spousal Property Petitions
Surviving spouses and domestic partners can often use a specialized petition to transfer community property regardless of the estate's value.
If the estate exceeds these limits or includes complex assets, a formal probate proceeding is generally required to clear title and ensure a legal transfer of ownership.
What to Expect

The Formal Probate Process

A formal probate in Southern California typically takes 12 to 18 months, depending on the complexity of the assets and the court’s current schedule. The process generally follows these essential stages:

Opening the Case
We "lodge" the original will with the court and file a petition to open probate.

Appointing the Representative
The court issues "Letters" that grant the Executor (named in a will) or Administrator (if there is no will) the legal authority to act.

Inventory & Appraisal
A court-appointed Probate Referee must appraise the estate's assets to determine their fair market value.

Creditor Notification
We notify all known creditors, who then have a four-month window to file claims against the estate.

Final Distribution
Once all debts and taxes are settled, we petition the court for a final order to distribute the remaining assets to the beneficiaries.
Transparent and Defined

California Statutory Fees

In California, probate fees for both the attorney and the personal representative are set by law (Probate Code § 10810). These are calculated based on the “gross” value of the estate (the value before any mortgages or debts are deducted).

  • Estate Gross Value: First $100,000 | Attorney Fee (Statutory): 4% ($4,000)
  • Estate Gross Value: Next $100,000 | Attorney Fee (Statutory): 3% ($3,000)
  • Estate Gross Value: Next $800,000 | Attorney Fee (Statutory): 2% ($16,000)
  • Estate Gross Value: Next $9,000,000 | Attorney Fee (Statutory): 1%

For an estate valued at $1,000,000, the statutory attorney fee is $23,000. Because these fees are paid directly from the estate assets at the end of the process, your family does not need to pay these legal fees out of pocket to begin the case.
